Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of coclimbing.com and any related pages, content, and features (the "Site"). The Site is operated by Climbing International,a Colorado LLC doing business as The Colorado Climbing Company.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. What This Site Is, and What It Is Not

The Site is an informational and marketing website. It publishes blog posts, route descriptions, conditions reports, trip reports, and general information about climbing in Colorado, and it describes the guided climbing tours and instruction we offer.

The Site itself is not a guiding service, an instructional service, or a safety resource. Reading this Site does not create a guide-client relationship, an instructor-student relationship, or any professional relationship between you and us. Nothing on the Site is professional advice about your safety, your fitness, your equipment, your technique, or your decision to climb.

We do not process payments on the Site. Bookings and payments are handled through separate third-party platforms as described in Section 6.

3. Climbing Is Dangerous, and Site Content Is Not a Substitute for Your Own Judgment

Read this section carefully.

Rock climbing, ice climbing, mountaineering, bouldering, scrambling, and approach travel are inherently dangerous activities that can result in serious injury, permanent disability, or death. These risks cannot be eliminated.

Route information, grades, gear recommendations, approach and descent descriptions, anchor information, conditions reports, weather observations, and any other content on the Site are provided for general interest only. This information:

  • may be inaccurate, incomplete, outdated, or wrong;

  • may describe conditions that have since changed, sometimes drastically and without warning;

  • may not reflect current rockfall, icefall, avalanche, snowpack, water, weather, wildlife, access, or closure conditions;

  • may not reflect current fixed hardware condition, including bolts, anchors, pitons, slings, and rappel stations, which degrade over time and can fail;

  • may not reflect current land access status, permit requirements, seasonal raptor or wildlife closures, or private property boundaries.

You are solely responsible for evaluating conditions, verifying information independently, assessing your own skills and fitness, choosing your partners, inspecting your own equipment and any fixed hardware you use, and deciding whether to climb. Do not rely on this Site as a primary safety resource.

By using the Site, you acknowledge and voluntarily assume all risks associated with any decision you make based in whole or in part on Site content

4. Climbing Partners and Meetups

Some Site content may reference climbing partners, meetups, gatherings, or community events. Any decision to meet, communicate with, or climb with another person is entirely your own.

We do not vet, screen, background-check, certify, endorse, supervise, or take responsibility for any person you encounter or connect with through or because of the Site, and we do not verify anyone's identity, skills, certifications, experience, or judgment. We are not a party to any arrangement you make with another climber, and we are not responsible for anyone's conduct, whether online or in person.

Use your own judgment about who you climb with. You assume all risk arising from any interaction, meeting, or climbing partnership that originates from or is influenced by the Site.

5. Bookings, Payments, and Guided Services Are Governed by Separate Agreements

Bookings for our guided tours and instruction are made through third-party platforms, which may include The Guide Network and FareHarbor. Payments are processed by third-party processors, which may include Stripe and Intuit QuickBooks.

When you book or pay through any of these platforms, you are transacting on that platform and are subject to that platform's own terms of service and privacy policy, in addition to these Terms. We do not control those platforms and are not responsible for their operation, availability, security, fees, or handling of your information.

Participation in any guided tour or instruction is separately conditioned on your execution of our participant agreement, assumption of risk, and release of liability, and on any additional booking terms, cancellation policies, and requirements we provide at the time of booking. Those documents, not these Terms, govern your participation in our services. If there is a conflict between these Terms and a participant agreement or booking terms you have signed, the participant agreement or booking terms control as to your participation in our services.

Nothing on the Site is an offer or a guarantee of availability, pricing, itinerary, guide assignment, or terms. All bookings are subject to confirmation and to our discretion, including our discretion to decline or terminate service for safety reasons.

6. Age Requirements and Minors

The Site is intended for adults. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact info@coclimbing.com and we will delete it.

Minors may not book our services independently. Booking and participation by anyone under 18 requires a parent or legal guardian to complete the booking and to sign all required participant agreements and releases on the minor's behalf.

If you are a parent or guardian and you permit a minor to use the Site, you agree to these Terms on that minor's behalf and you are responsible for the minor's use of the Site.

7. Intellectual Property

All content on the Site is owned by us or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. This includes, without limitation:

  • all blog posts, route descriptions, conditions reports, trip reports, guides, and other written content;

  • all photographs, images, video, maps, diagrams, and topos;

  • the "Colorado Climbing Company" name, the coclimbing.com name, our logo, and any associated marks, whether or not federally registered;

  • the design, layout, structure, arrangement, and "look and feel" of the Site;

  • any compilation or organization of the foregoing.

Nothing in these Terms transfers any ownership or license to you.

You may: view, read, and print Site content for your own personal, non-commercial use, and share links to Site pages.

You may not, without our prior written permission:

  • copy, reproduce, republish, mirror, distribute, or publicly display Site content, in whole or in substantial part, on any other website, platform, publication, or medium;

  • create derivative works from Site content, including rewriting, paraphrasing, translating, or "spinning" our route descriptions or written content;

  • use our name, logo, or marks in any way that suggests affiliation, sponsorship, or endorsement;

  • use Site content for any commercial purpose, including in a competing guide service, guidebook, app, or content business;

  • scrape, crawl, harvest, index, or extract Site content by automated means, except by general-purpose search engine crawlers operating in compliance with our robots.txt;

  • use Site content to train, fine-tune, or ground any machine learning model, large language model, or generative AI system;

  • remove, obscure, or alter any copyright, trademark, or attribution notice.

Requests for permission and copyright complaints, including takedown requests, go to info@coclimbing.com.

8. Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;

  • attempt to gain unauthorized access to the Site, its servers, or any related systems;

  • interfere with or disrupt the Site, including by introducing malware or by placing unreasonable load on our infrastructure;

  • probe, scan, or test the vulnerability of the Site;

  • impersonate us, our guides, or any other person;

  • misrepresent your affiliation with us;

  • use the Site in any manner that could damage, disable, or impair the Site or interfere with anyone else's use of it.

We may restrict or terminate your access to the Site at any time, for any reason, without notice.

9. Third-Party Services and Links

The Site uses and links to third-party services, which currently include or may in the future include booking platforms (The Guide Network, FareHarbor), payment processors (Stripe, Intuit QuickBooks), analytics (Google Analytics), an AI chatbot provider, advertising and measurement tools (including the Meta pixel), and email marketing services (including Mailchimp).

These services are operated by third parties under their own terms and privacy policies. We do not control them and are not responsible for their content, practices, availability, or handling of your information.

The Site may also link to other websites, guidebooks, land manager pages, weather services, forums, and resources. Links are provided for convenience only and are not an endorsement. We are not responsible for the content or accuracy of any linked site.

'The Site may make an AI-powered chatbot or automated assistant available. Any response it generates is produced automatically and is not reviewed by a human before you see it.

Do not make climbing, route-finding, retreat, rescue, medical, or safety decisions based on chatbot output. Verify anything that matters with a qualified human source. For binding information about our services, pricing, or availability, contact us directly at info@coclimbing.com.

Do not submit confidential, sensitive, or personal information to the chatbot. Conversations may be processed and stored by our third-party chatbot provider.

10. Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE SPECIFICALLY MAKE NO WARRANTY THAT ANY ROUTE INFORMATION, CONDITIONS REPORT, GRADE, GEAR RECOMMENDATION, HAZARD DESCRIPTION, ACCESS INFORMATION, OR CHATBOT RESPONSE IS ACCURATE, CURRENT, COMPLETE, OR SAFE TO RELY ON.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, GUIDES, INSTRUCTORS, CONTRACTORS, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

THIS SECTION APPLIES TO YOUR USE OF THE SITE. IT DOES NOT LIMIT, EXPAND, OR OTHERWISE GOVERN LIABILITY ARISING FROM YOUR PARTICIPATION IN GUIDED TOURS OR INSTRUCTION, WHICH IS ADDRESSED IN THE SEPARATE PARTICIPANT AGREEMENT AND RELEASE YOU SIGN AT BOOKING.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing in these Terms is intended to release any claim for willful and wanton conduct or gross negligence where such a release is prohibited by law. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Climbing International LLC and its owners, members, managers, officers, employees, guides, instructors, contractors, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your violation of these Terms, your violation of any law or any third party's rights, or any decision you make in reliance on Site content.

14. Changes to the Site and to These Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice.

We may revise these Terms at any time. Revisions take effect when posted, and we will update the "Last updated" date above. Your continued use of the Site after a revision constitutes acceptance of the revised Terms. Review these Terms periodically.

15 Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Colorado, without regard to its conflict of laws principles.

Subject to the arbitration provision in Section 16, you and we agree that the exclusive venue for any action permitted to be brought in court is the state or federal courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.

16. Dispute Resolution and Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

a. Informal resolution first. Before starting an arbitration, you agree to contact us at info@coclimbing.com with a written description of the dispute and the relief you seek, and to allow us 30 days to attempt to resolve it informally.

b. Agreement to arbitrate. If we cannot resolve the dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or to your use of the Site will be resolved by final and binding individual arbitration, rather than in court, except as provided in subsection (e).

c. Arbitration procedure. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted by a single arbitrator. Unless you and we agree otherwise, any in-person hearing will take place in [COUNTY] County, Colorado, and the arbitrator may allow telephonic or video proceedings. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

d. Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim, that claim shall proceed in court and be severed from any arbitration.

e. Exceptions. Either party may bring an individual action in small claims court. Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or to address unauthorized access to or misuse of the Site.

f. Your right to opt out. You may opt out of this arbitration agreement by sending written notice to info@coclimbing.com within 30 days of your first use of the Site. Your notice must include your name, mailing address, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

g. Scope. This section does not apply to any dispute arising from your participation in a guided tour or instruction, which is governed by the dispute resolution provisions of the participant agreement you sign at booking.

17. General

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site, and supersede any prior understandings on that subject. They do not supersede any participant agreement, release, or booking terms you sign with us.

Headings. Section headings are for convenience only and do not affect interpretation.
